Meloyra operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Meloyra is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

We do not warrant that the appearance or quality of any products purchased by you will meet your expectations or be exactly the same as depicted in our online store.

All product descriptions are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, household, geographic region or jurisdiction, on a case-by-case basis.

SECTION 3 — PRODUCT USE AND HEALTH DISCLAIMER

The Meloyra Gel Seat Cushion is a comfort product designed to make everyday sitting more comfortable. It is NOT a medical device and is not intended to diagnose, treat, cure or prevent any disease or medical condition.

Information on our website, including product descriptions, customer stories, blog content and frequently asked questions, is provided for general information purposes only and is not medical advice. Individual experiences may vary.

If you have ongoing pain, a medical condition, a pressure injury, or have recently had surgery (including bariatric surgery), please consult your doctor or a qualified healthcare professional before using our products.

Please use our products as intended and in accordance with the care and use instructions provided. Do not expose the gel cushion to direct heat, sharp objects or excessive weight, and keep it out of reach of young children and pets. Stop using the product if you experience discomfort.

SECTION 4 — ORDERS

When you place an order, you are making an offer to purchase. Meloyra reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Meloyra confirms acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting, as we may be unable to accommodate change or cancellation requests once order processing has begun. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email, billing address and/or phone number provided at the time the order was made.

Your purchases are subject to return or refund solely in accordance with our Refund Policy.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 5 — PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.

We may offer promotions from time to time that are governed by separate terms and conditions. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our store, and to promptly update this information so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the payment information you provide is true, correct and complete, (ii) you are duly authorized to use such payment method for the purchase, (iii) charges incurred by you will be honored by your payment provider, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.

SECTION 6 — SHIPPING AND DELIVERY

Orders are typically processed within 1–3 business days. Delivery within the United States usually takes 6–9 business days after shipment. All delivery times are estimates only and are not guaranteed.

We are not responsible for delays caused by shipping carriers, customs processing, weather, holidays or other events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you.

For international orders, you are solely responsible for any customs duties, import taxes or fees imposed by your country. We have no control over customs processing times and are not liable for any delays or additional charges incurred at the border. If a package is refused at customs or returned due to unpaid duties, any refund will be issued at our sole discretion and may be subject to a return shipping deduction.

Meloyra's name, logo, product names, designs and slogans are trademarks of Meloyra or its affiliates or licensors. You must not use such trademarks without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos and trademarks on the Services belong to their respective owners.

SECTION 8 — OPTIONAL TOOLS

You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor have any control over. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability arising from or relating to your use of optional third-party tools.

Meloyra is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Meloyra. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Meloyra, including any injury, damage or loss resulting from purchased products. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Meloyra.

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL MELOYRA, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SUPPLIERS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO MELOYRA FOR THE PRODUCT GIVING RISE TO THE CLAIM.

SECTION 18 — INDEMNIFICATION

You agree to indemnify, defend and hold harmless Meloyra, Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

SECTION 19 — COMPLAINTS AND DISPUTE RESOLUTION

Contact us first. If you have a complaint, please contact us at support@meloyra.com with a short description of the issue and your order number. We aim to resolve every complaint quickly and fairly, and in any case within thirty (30) days.

Payment Disputes and Chargebacks. Before initiating a chargeback or payment dispute with your card issuer or bank, we encourage you to contact us at support@meloyra.com so that we can resolve the matter directly, for example under our 90-day return policy. We reserve the right to dispute any chargeback we believe to be filed in error or in bad faith.

Your Consumer Rights. Nothing in these Terms limits any mandatory consumer protection rights you have under the laws of your state of residence. If we cannot resolve a dispute together, you may bring a claim in the small claims court of your state, where available.

SECTION 20 — SMS / TEXT MESSAGE MARKETING

By providing your phone number and opting in to receive text messages from Meloyra, you consent to receive recurring automated marketing text messages (such as promotions, offers and order updates) from us at the number provided. Consent is not a condition of any purchase.

Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP to any message. For help, reply HELP or contact us at support@meloyra.com. Carriers are not liable for delayed or undelivered messages.

We handle the information you provide in line with our Privacy Policy. We do not sell your mobile information for marketing purposes. By opting in, you confirm that you are the account holder or authorized user of the phone number provided and are at least the age of majority.

SECTION 21 — SEVERABILITY

If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.
